General Terms and Conditions

1.- General Conditions

The guest making the reservation declares that they are of legal age and fully capable of contracting and using payment methods. The guest also accepts all the general terms and conditions of the contract. The guest guarantees that all personal information provided during the accommodation reservation and service registration process is correct. The final price includes all mandatory service fees for our apartments, as well as the Value Added Tax (VAT) applicable to the tourism sector in European Community countries. The price does not include extra services not specified in the reservation (such as parking, towel changes, cleaning, etc.). The final amount of your reservation may vary if you change the number of nights and people. Adding people without prior notice and outside the free modification/cancellation period of your reservation will incur a penalty of €50 per person per night. Once the reservation is made, an email will be sent with the reservation details, where you can access the guest portal and any confirmations. The different promotions and discounts offered are subject to specific conditions, cannot be combined with other promotions, and are subject to availability.

2.- Payment Conditions

Payment will be made in advance, either in full or in part, before arrival at the apartments and is subject to the specific modification and/or cancellation conditions for each rate or reservation date, through our bank, via the “Secure Payment Gateway” to comply with European legislation regulating payment services (PSD2) to reduce fraud and make transactions safer through enhanced authentication. The establishment reserves the right, once the reservation is confirmed, to pre-authorize your credit card. The guest accepts financial responsibility for all transactions made on their behalf or through their account.

3.- Modification and Cancellation

Conditions All requests for cancellation or modification must be made in writing to the following email: info@apartamentoselpatioandaluz.com. Reservations with a refundable rate (Flexible Rate) made through our website can be canceled without charge up to 14 days before the arrival date. In case of cancellation outside the deadlines, no-show on the reservation day, or early departure, the reservation will be canceled, and 100% of the amount will be charged. Non-refundable rate reservations will be paid at the time of booking and will not be refunded if canceled or modified at any time afterward. IMPORTANT: Modifying the number of people without prior notice and outside the free modification or cancellation period will result in a price update of €50 per person per night not included in the reservation. Failing to inform us about this authorizes us to cancel your reservation without any compensation.

4.- Accommodation Rules

SCHEDULES: The general check-in time for our apartments is from 2:00 p.m. on the day of arrival, and check-out is before 11:00 a.m. Non-compliance with the check-out time will incur a penalty of €50. This schedule can be adapted to the client’s needs if availability allows; for this, it is essential to contact the property, and if a late check-out is possible, the rate is €25 until 6:00 p.m. By informing us of your arrival time, you help us organize the cleaning of the apartment to make it available as soon as possible.
DEPOSIT: The reservation holder is responsible for any damage caused by themselves, their companions, or pets. On the departure day, the property must be in the same orderly and clean condition as on arrival. This will be inspected upon departure and during the 7 days following departure for any anomalies. During this period, the corresponding amount may be deducted from the deposit, or if no deposit was provided, the charge will be applied, with prior notice, to the reservation holder’s credit card.
CLEANING: The reservation price includes a weekly change of sheets and towels. You can request an apartment cleaning for €25 with a change of sheets and towels (for 2 people). If you only need a change of sheets and towels: €5 per person.
COMPLAINTS: Please report any deficiencies you find in the furniture or cleanliness as soon as possible during your stay so we can address them.
VISITS: Visits are not allowed. The agreed price is for the agreed number of occupants. Any excess in this number, at the time of occupancy or later, entitles the collection of a supplement of €50 per extra person per night and/or the immediate termination of the agreed rental without any compensation.
KEYS: Upon arrival, you will receive a set of keys for each apartment, and you must return it upon departure. Failure to do so will incur a charge of €150 for changing locks, key copies, etc.
SMOKING: In compliance with Law 42/2010 of December 30, 2010, smoking is strictly prohibited inside the apartments, under penalty of €200. Smoking is allowed in the outdoor patios.
PETS: Pets are allowed upon request and prior notice. Extra cost of €25 per pet per stay. Maximum of 2 pets per apartment.
COMMON AREAS: The two outdoor patios of the house are for shared use and cannot be used after 11 p.m. Additionally, noisy, unhealthy, harmful, dangerous, or illegal activities are prohibited.
All common areas are under video surveillance.

5.- Legal Notes

In compliance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, you are informed that the personal data provided in this form will be collected and incorporated into a file owned by the property and that your data has been obtained by the recipient itself or from publicly accessible sources. The purpose of this processing will be the management and periodic sending of our electronic newsletter. The interested party will always enjoy the rights of access, rectification, cancellation, and opposition of the data collected by communicating to the address info@apartamentoselpatioandaluz.com. If you do not wish to receive further information, you can notify us at the same address, otherwise, we understand that you expressly understand and consent to the processing of your data.
